NovaLogic, the developer behind the long running Delta Force video game franchise, is filing an injunction for trademark infringement over Activision‘s similar Delta Force logo used in Modern Warfare 3.
According to Gamasutra, NovaLogic warned Activison numerous times of potential legal action.
NovaLogic is none-too-pleased with Activision, claiming that they have lost “millions of dollars, possibly more,” due to Activision’s alleged trademark infringement.
The official legal papers, courtesy of Courthouse News, state “Despite Activision’s irrefutable knowledge of NovaLogic’s superior trademark rights, Activision created knockoff marks that are nearly identical [to] NovaLogic’s design and word marks. Activision then shamelessly inserted these infringing marks throughout its competing first person military adventure video games.”
As many have pointed out, the Delta Force name is possibly most recognizable as the title of a 1986 Chuck Norris film, The Delta Force. Since Delta Force is actually a name for a specific military unit, the name itself can’t be trademarked.
If NovaLogic and Activison can’t settle this, I know a man who can. He calls his fists “Law” and “Order.”
